The following contractual conditions apply to all contracts concluded between Schaper Automotive and the respective buyer and are expressly recognized with the order.

2. Conclusion of the contract

You can use our online shop system at www.schaper-automotive.com for free.

The goods intended for purchase are to be placed in the "shopping cart". You can use the “shopping cart” button in the navigation bar to call up the “shopping cart” and make changes there at any time. After pressing the “Checkout” button and then entering your personal data, all order data will be displayed again on the following page. Before submitting the order, you have the opportunity to check all the information again and, if necessary, to change it using the back function of your Internet browser or to cancel the order process at any time.

By clicking the “Order with obligation to pay” button, you are submitting a binding offer to conclude a purchase contract with us. You will first receive an automatic email about the receipt of your order, which does not yet lead to the conclusion of a contract.

The acceptance of your offer (and thus the conclusion of the contract) takes place by sending a separate order confirmation by email from Schaper Automotive.

Our contract languages ​​are German, English and Russian.

3. Prices, delivery and shipping costs

The prices listed in the respective offers represent final prices.

You may only have to pay additional taxes (e.g. in the case of an intra-Community acquisition) and / or duties (e.g. customs duties) in individual cases for cross-border deliveries, but not to Schaper Automotive, but to the customs or tax authorities responsible there.

The delivery and shipping costs incurred are not included in the purchase price; they can be called up on the “Delivery and shipping costs” page, are shown separately in the course of the ordering process and are to be borne by you in addition.

4. Delivery and shipping conditions

If no copies of the product selected by the customer are available at the time the customer orders, Schaper Automotive will inform the customer of this in the order confirmation. If the product is permanently unavailable, Schaper Automotive will refrain from a declaration of acceptance. A contract is not concluded in this case.

If the product specified by the customer in the order is only temporarily unavailable, Schaper Automotive will also inform the customer of this immediately in the order confirmation. If the delivery is delayed by more than two weeks, the customer has the right to withdraw from the contract. In addition, in this case Schaper Automotive is also entitled to withdraw from the contract. Schaper Automotive will immediately reimburse any payments already made by the customer. The goods are dispatched at the choice of the desired logistics partner.

5. Payment terms

We usually deliver in advance. Our bank details are given in the order confirmation. The German sales tax is shown. Payment of the purchase price must be made within 7 days of the conclusion of the contract. As a rule, goods are only dispatched after the bank credit has been received.

6. Retention of Title

The goods remain the property of Schaper Automotive until they have been paid for in full.

7. Right of withdrawal for consumers

The statutory right of withdrawal applies.

In order to exercise your right of withdrawal, you must send a clear declaration to us (Schaper Automotive, Paul-Lincke-Str.1F, 30890 Barsinghausen, email: info@schaper-automotive.com, telephone number: +49 (0) 172/4604899) B. a letter sent by post or e-mail) of your decision to withdraw from this contract. Consequences of withdrawal

If you withdraw from a contract, the seller has to give you all payments that he has received from you, including delivery costs (with the exception of the additional costs that result from the fact that you have a different type of delivery than the cheapest standard delivery offered by the seller have chosen) to repay immediately and at the latest within fourteen days from the day on which the notification of your cancellation of the contract was received by the seller. For this repayment, the seller uses the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. The seller can refuse the repayment until he has received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier. You have to return or hand over the goods to the seller immediately and in any case no later than fourteen days from the date on which you informed the seller of the cancellation of the contract. The deadline is met if you send the goods before the period of fourteen days has expired. In the event of a timely cancellation of the contract, the buyer bears the costs of returning the goods in the case of goods that can be sent as parcels. In the case of goods that cannot be sent as a parcel, the seller bears the costs of collecting the goods. The consumer only has to pay for any loss in value of the goods if this loss in value is due to handling you that is not necessary to check the nature, properties and functionality of the goods.

Exclusion of the right of withdrawal or reasons for expiry

The right of revocation does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the customer is decisive or that are clearly tailored to the personal needs of the customer. The right of withdrawal expires prematurely in the case of contracts for the delivery of sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. The right of withdrawal also expires prematurely in the case of contracts if they were inseparably mixed with other goods after delivery due to their nature and in the case of the delivery of computer software in a sealed package, if the seal was removed after delivery.

8. Warranty

The statutory warranty law applies to the goods.

A guarantee exists for the goods delivered by Schaper Automotive only if this was expressly given in the order confirmation for the respective article.

9. Liability for defects

The statutory warranty rights exist.

As a consumer, you are requested to check the goods for transport damage, completeness and obvious defects immediately upon delivery and to notify us and the freight forwarder of any complaints as soon as possible. If you fail to do so, this has no effect on your statutory warranty claims. If you buy goods from us as an entrepreneur within the meaning of § 14 BGB, your claims for defects expire within 12 months from delivery of the goods. Excluded from this are claims due to injury to life, body or health that are based on an intentional or negligent breach of duty on our part, our legal representatives or vicarious agents.

10. Liability and information on putting the products into operation in traffic

The product liability law applies.

In the event of a slightly negligent breach of these contractual obligations, we are only liable for typical, foreseeable damage, unless it concerns claims for damages from injury to life, body or health.

We expressly point out that none of the products we offer for sale are approved according to the StVZO and that these products are only intended for motorsport purposes in non-public traffic areas. These are short-lived high-performance parts for motorsport.

11. Storage of the contract text

The contract text is not stored by us. However, after the contract has been concluded, you will receive an order confirmation with all essential information by email. You also have the option of printing out the essential data of your order, your cancellation policy and our terms and conditions during the ordering process. After completing the order processing, the contract text is no longer accessible to you.

12. Place of performance, place of jurisdiction

German law applies exclusively.

The place of performance for all services from existing business relationships with Schaper Automotive and the place of jurisdiction is the seat of Schaper Automotive.
